Responsibilities:

While the Photographer will make every reasonable effort to take photos specifically requested by Client, Client understands that this is an uncontrolled event and that due to the vagaries of the weather, available light, time restrictions and the willingness of subjects, Photographer cannot guarantee that ALL requested photographs will be taken.

Photographer takes the utmost care with respect to exposure, transportation and processing the photographs. However, in the unlikely event that all the photographs have been lost, stolen, damaged or destroyed for reasons beyond the Photographer’s control, Photographer’s liability is limited to the return of all payments received for the session. A request can be placed to do a reshoot all depending on the type of session.

 

If the Photographer is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, or technical problems and if he cannot provide another competent professional, all money received by Photographer, minus expenses, will be returned to Clients and Photographer shall have no further liability with respect to their agreement.

Liabilities:

The Photographer will not be held responsible for any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

Coverage:

Photographer will provide coverage for the dates, locations and continuous hours specified. Additional travel or coverage hours may be added by agreement on the session day and must be paid in full before the end of the session and/or any photos or products are released to the client. Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. Any lists supplied will be used for organizational purposes only. Images determined by the Photographer to be substandard or duplicated may be edited out. The Photographer will provide the client with all sample images within 48 hours after the completion of the shoot, unless otherwise agreed with the client. The client will then have 30 days to send the photographer the list of photos. If the client takes longer than 30 days, the photographer will not be obliged to have the final images ready within the 3-4 weeks’ timescale. Please note that the photographer can only guarantee that photos will be stored for a period of 6 months from the date of the session. After that they may be permanently deleted. It is up to the client to contact the photographer with the list of photos they want edited, before this time period is over. The photographer is not held responsible if you ask for the photos and they are no longer available. If this is the case you will not be eligible for a refund.

 

Payment:

50% of the agreed upon fee between the Client and the Photographer for the session is due within 3 days of booking the session. This is a non-refundable deposit. The balance is then due at the time of the shoot unless other previous arrangements are made with the Photographer. If extra images are purchased after the shoot, payment is due before they are edited. Any charges incurred in shipping prints or products will also be billed to the client and payment is due at the time the order is placed. Prices for prints, products and digital images are valid for a period of thirty days after the date of your session.

Cancellation:

Cancellations can be made up to 24 hours before the session apart from Smash & Splash Sessions where a 48 hour notice has to be given. If cancelled on time the session can be rescheduled. If cancelled after that the deposit will be lost and a new one would have to be paid to schedule a new session.

 

Copyrights and Reproduction:

All photographs taken by Angelique Fernandez are the property of Pause & Pose Photography and are protected by Copyright Laws. The Photographer shall retain the copyrights in perpetuity, regardless of possession or ownership of photographs, digital files or any other format of reproduction. You agree to purchase prints and products directly from Pause & Pose Photography unless in possession of high-resolution digital files. You agree not to make copies for sale or for the purpose of circumventing sale of the images by Pause & Pose Photography. Clients may not reproduce images in any manner without the Photographer’s explicit written permission. The photographer will provide the client with two copies of each image one with and one without watermark. All photos published on social media or printed media must have the watermark of the Photographer. Final images must not be edited in any way, this includes filters when uploading onto social media.
